Terms of Use Policy for American Prepping Academy

1. Acceptance of Terms

• By accessing and using the American Prepping Academy app (hereinafter referred to as "the App"), you agree to comply with and be bound by these Terms of Use. Please review these terms carefully. If you do not agree to these terms, you should not access or use the App.

2. Content Submission and Grant of Rights and Permissions

• a. As a content creator ("Contributor") submitting video and audio content to the App, you expressly grant American Prepping Academy and its affiliates a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, embed, distribute to App users, re-distribute content streamed from Youtube and or Rumble, display, and stream the content in connection with the App and American Prepping Academy's (and its successor's) business, including without limitation for promoting and redistributing part or all of the App.
• b. The Contributor affirms that they have all necessary rights, licenses, consents, and releases necessary to grant the aforementioned license to American Prepping Academy without violating any third-party rights, including copyright, trademark, privacy, and publicity rights.
• c. By submitting content to the App, the Contributor understands and agrees that the content may be shared, viewed, and accessed by other users of the App and platforms where the App promotes its content.

3. Contributor Representations and Warranties

• The Contributor represents and warrants that:
  • a. The content they submit does not infringe on any third-party rights, including copyrights, trademarks, or rights of privacy and publicity.
  • b. They have obtained any and all permissions, releases, and consents necessary to share the content on the App and grant the rights mentioned herein.
  • c. The content complies with all applicable laws, rules, and regulations.

4. Indemnification

• The Contributor agrees to indemnify, defend, and hold harmless American Prepping Academy, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to the content they submit to the App or their breach of these Terms of Use.

5. General Provisions

• a. Amendments: American Prepping Academy reserves the right to modify or amend these Terms of Use at any time. Contributors will be notified of any changes, and continued use of the App after such modifications will constitute acknowledgment and acceptance of the modified terms.
• b. Governing Law: These Terms of Use shall be interpreted, governed by, and construed under the laws of the United States of America, excluding its principles of conflict of laws.
• c. Entire Agreement: These Terms of Use constitute the entire agreement between the Contributor and American Prepping Academy regarding the subject matter hereof and supersede all prior or contemporaneous understandings, agreements, communications, and proposals.
